Terms of use

These terms govern the use of Ballistics Club, the club management service provided by Aaron Cross trading as Veeprox (ABN 73 855 231 595) (“Veeprox”, “we”). By using the service you agree to these terms. If your club has a signed agreement with Veeprox, that agreement prevails over these terms wherever the two differ.

1. The service

Ballistics Club is an online service that helps sporting shooting clubs manage their members, events, attendance and compliance records. The service is provided over the internet: there is nothing to install, and we look after hosting, maintenance and upgrades.

2. Accounts

Your club’s administrators control who can access the club’s workspace and what they can see. You agree to provide accurate account information, keep your sign-in credentials to yourself, and tell us promptly if you believe your account has been compromised. You are responsible for activity that happens under your account.

3. Acceptable use

Use the service lawfully and only for managing your club. Don’t attempt to interfere with the service’s security, access another club’s information, probe or overload the service, or use it to store content that is unlawful or that you don’t have the right to hold.

4. Your club’s information

Your club’s information belongs to your club, not to us. We host it and process it only to provide the service, and we never sell it or share it with anyone except the service providers we use to run Ballistics Club (such as our cloud hosting provider). The service is hosted in Australia.

Where the portal provides export tools, your club can export its own records whenever it likes, in commonly used formats (such as CSV). Other exports can be arranged as support work under your club’s agreement or plan, and are provided within a reasonable time. If your club stops using the service, we will delete the club’s information from the service in line with our data retention practices, and sooner if your club asks. Copies in routine backups are not restored and expire in the ordinary backup cycle, and we may keep records we are required by law to retain (such as invoicing records). We keep regular backups while the service operates.

5. Availability and support

We take reasonable efforts to keep the service available at all times, and we’ll let your club know in advance of planned maintenance where practical. The service depends on the internet and on third-party providers, and we are not responsible for failures of networks, utilities or services outside our control. Support is provided according to your club’s agreement or plan.

6. Compliance records and forms

The service helps your club prepare and keep records and regulatory forms (for example, Western Australia Police Force firearms forms) from the information your club enters. Your club remains responsible for meeting its own legal and regulatory obligations, including checking that each form and record is accurate and complete before it is signed or lodged, and lodging it on time. Veeprox does not provide legal advice.

7. Fees

Fees are as set out in your club’s agreement or plan. Unless stated otherwise, fees do not include GST; where GST applies, it is added at the prevailing rate and shown on a tax invoice.

8. Suspension and ending the service

We may suspend access if fees remain unpaid after reasonable notice, or immediately if the service is being misused in a way that puts the service or other clubs at risk. We’ll always tell you why, and restore access once the issue is resolved. If the service ends, the data commitments in section 4 apply.

9. Liability

Neither party is liable to the other for indirect or consequential loss. Our total liability under these terms is capped at the fees your club paid in the 12 months before the event giving rise to the claim. Nothing in these terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law or any other right that cannot lawfully be excluded.

10. Changes to these terms

We may update these terms from time to time. We’ll give your club at least 30 days’ notice of any material change, and continuing to use the service after that notice means the updated terms apply. A signed agreement between Veeprox and your club still prevails over any change.
